SALT LAKE CITY — The Utah State Senate convened an extraordinary session in September 2012 and approved a slate of gubernatorial appointments by a roll-call vote of 25–0, with four senators absent.
The session opened with a proclamation from Governor Gary R. Herbert calling the seventh extraordinary session so the Senate could consider appointments made since the close of the 2012 general session. The reading clerk presented letters from the governor transmitting nominations, including Salvador D. Pedelos to replace Francine Agiani as director of the Department of Alcoholic Beverage Control and Harris H. Simmons to the State Board of Regents.
The Business and Labor Confirmation Committee reported unanimously in favor of Salvador D. Pedelos. "The committee voted unanimously to recommend that the Utah Senate approve the nomination of Salvador D. Pedelos as the director of the Department of Alcoholic Beverage Control," the committee report stated, read into the record by the reading clerk.
Senator Aaron Osman, reporting the Senate Education Confirmation Committee’s recommendation for Harris H. Simmons, summarized the committee’s view: "He has a very deep and broad background both in business and community service and we found his appointment acceptable to the Senate," Osman said.
Following the reading of additional nominations — including appointments to the Real Estate Appraiser Licensing and Certification Board, the Permanent Community Impact Fund Board, and the Utah Commission on Uniform State Laws — Senator Hilliard moved that the Senate consent to the names as read. The presiding officer ordered a roll-call vote; the clerk recorded the votes and the presiding officer announced the result: 25 yes, 0 no, 4 absent. The presiding officer declared the governor’s appointments confirmed.
The session included brief procedural business: the Senate adopted its existing rules for the extraordinary session, appointed a small committee to notify the governor’s representative that the body had convened, and concluded after welcoming nursing students from the University of Utah. The presiding officer adjourned the Senate following a successful consent vote.
The governor’s letters read into the record invoked Utah Code Annotated sections 67-1-1 and 67-1-2 as authority for transmitting appointments to the Senate. The reading clerk’s messages and committee reports entered the nominations and recommendations into the public record; the confirmations were administrative approvals rather than debates over policy.
With the confirmations complete, the Senate adjourned its seventh extraordinary session.
