Utah Senate convenes extraordinary session and unanimously consents to three gubernatorial appointments

Herbert, citing Article 7, Section 6 of the Utah Constitution, was read calling the Senate into extraordinary session "for the senate to consent to appointments made by the governor to positions within state government of the state of Utah since the close of the 2012 general session of the legislature of the state of Utah." The proclamation specifies the session was called for November 2012 at 1:30 p.m. and was signed by Governor Gary R. Herbert and Lieutenant Governor Greg Bell.
Communications from the governor, read under authority of Utah Code Annotated 67-1-1 and 67-1-2, transmitted three appointments for the Senate's consideration: Kevin Joseph Potts to the Health Data Committee to replace Scott Eastman; Ann Marie Allen to the Southern Utah University Board of Trustees to replace Nina Barnes; and Akiko Kawamura to replace Bob Thompson as administrator of the career service review office. The communications were presented to the body for timely consideration and confirmation.
Senator Hillier moved that the Senate approve the list of appointments that had been read that afternoon. After a roll call, the presiding officer announced, "The vote to consent to the governor's appointments is 21 yays, 0 nays," with eight senators absent, and declared the appointments consented to. Following the vote, the presiding officer directed Senator Van Tassel to reconvene the committee and notify the governor of the action; Van Tassel confirmed the committee had notified the governor that the work was complete.
Later on the floor, Senator Davis — who said he had been off the floor earlier — asked to be recorded as an "aye" on the confirmations; Senator Robles joined that request. The Senate granted leave and recorded them as aye votes. The presiding officer also announced there may be another judicial appointment and that the Senate could be recalled for an additional consent session in December pending committee scheduling.
The session adopted the same procedural rules the Senate had been following for the 50 ninth legislature before taking the appointments up. The Senate adjourned after a brief set of floor remarks and a motion to adjourn by Senator Jenkins carried.
The confirmations place Kevin Joseph Potts, Ann Marie Allen and Akiko Kawamura into the referenced state roles; the transcript did not record any separate confirmation hearings for those nominees. No additional votes or contested nominations were recorded during the extraordinary session.
