A Governor Gary R. Herbert letter notifying the Senate of the appointment was read on the floor; the Senate judicial confirmation committee reported a favorable recommendation for Wilcox. Senator Jenkins, the committee chair, told the Senate the committee conducted a thorough review and unanimously recommended the nominee.
On the floor, Senator Hilliard moved confirmation. Senator Reid declared a potential conflict of interest related to pro bono work his son‑in‑law had received from the nominee’s firm but said he would vote in support. The roll call was taken and later announced as 28 'yay' and 0 'nay'.
Judge‑designate Jeffrey C. Wilcox introduced family members in the gallery and thanked the governor and the confirmation committee. Wilcox said he will “do my best to do my duty to uphold the rule of law in a fair and efficient and impartial manner” as he assumes duties on the Fifth Judicial District bench in southern Utah.
