Utah Senate confirms Jennifer Brown to Fourth District Court, approves multiple governor appointments

The Utah State Senate convened its first extraordinary session Tuesday, Jan. 13, 2015, to consider a series of appointments transmitted by Gov. Gary R. Herbert. The Senate confirmed Jennifer Brown as a judge of the Fourth District Court and later consented to a package of appointments to state boards and commissions.
The confirmation of Jennifer Brown followed a favorable recommendation from the Senate Judicial Confirmation Committee. Chair Scott Jenkins told the Senate the committee found Brown “very competent” and moved that the body consent to the governor’s nomination. The Senate recorded 26 yays, 0 nays and 3 absent on the roll call, formally confirming Brown to the bench. “Congratulations, Judge Brown,” President Wayne L. Niederhauser said after the vote.
After her confirmation, the Senate resolved into a Committee of the Whole for Brown to speak. Judge Jennifer Brown introduced family members in the gallery, including her mother, Elsie Green, and her sons, and thanked the body for the opportunity. Brown recounted the path that led her to the bench and told senators she intended to “serve in a capacity and with diligence and... not let any of you down.”
Later in the session the Senate considered additional appointments transmitted in a Dec. 30, 2014 communication from the governor. The list included an interim manager for the Utah Office of Inspector General, a reappointment to the Public Service Commission, appointments to the Permanent Community Impact Fund Board, the Alcoholic Beverage Control Commission, the Board of Pardons and Parole, the Title and Escrow Commission and members of a health facility committee. The Business and Labor Confirmation Committee reported favorable recommendations for nominees such as Steven B. Bateman and Robert E. Rice.
The Senate held a roll call on consenting to those nominations and recorded 24 yays, 0 nays and 5 absent. The chamber then dissolved the Committee of the Whole, recognized guests in the gallery, and adjourned the extraordinary session.
The appointments cited statutory authority in the governor’s transmittals, including Utah Constitution Article VIII, Section 8 and Utah Code §78-10-101 for the judicial nomination. The confirmations were final in the Senate on Jan. 13, 2015, and the confirmed appointees were welcomed to begin their duties according to the offices’ procedures.
