Senate backs settlement in UDOT SR‑92 dispute with Flatiron‑Harper joint venture

The Utah Senate voted to approve Senate Joint Resolution 101, which endorses a proposed settlement in litigation involving the Utah Department of Transportation (UDOT) and the Flatiron‑Harper joint venture over SR‑92 construction.
Sponsor Senator Harper described the project history and said the settlement effectively reduces the state’s exposure. "They...reduce the amount of the $113,000,000 contract to what has already been paid, $102,000,000," Harper said, and explained that the settlement leaves funds with UDOT to address potential future repairs.
Senator Hilliard asked whether the remaining roughly $8 million would be paid to defaulting contractors or retained by UDOT. Harper answered that the retained funds would stay with UDOT so it could hire another contractor to perform future repairs. "That money will stay...with UDOT, so that if there are any future repairs, UDOT can hire somebody else to fix it," Harper said.
Senators described the settlement as fair and said preserving funds for repairs and longevity of the road was the objective. The resolution was passed under suspension of rules and transmitted to the House for the Speaker’s signature.
The resolution does not itself appropriate new funds; it approves the administration’s settlement terms for the SR‑92 dispute and directs the legislative copy be transmitted to the House for concurrence.
