"If the legislature chooses not to fund the appropriation attached to this bill, then Energy Solutions continues to pay the full... oversight program," Hemmert said.
Critics said the proposal amounted to a special break for a single company. Sen. DeBackus called the change "one of the granddaddies of all" special tax breaks and urged colleagues to consider fairness to small businesses that do not receive similar credits. Sen. Harper raised concern about a roughly $1.7 million reduction to general fund revenues tied to the credit.
Supporters countered that Energy Solutions faces a unique fee structure and that the bill corrects a double-assessment problem identified by earlier task forces and sponsors. Sen. Bramble, who helped create the original fee and tax structure, said the bill seeks equity rather than exemption and does not eliminate the company’s responsibility for remediation and oversight costs.
The Senate advanced the bill toward a third reading after approving floor amendments and scheduling the measure for third-reading votes.
