Senate approves bill clarifying local elected officials’ authority over police departments

The Utah Senate on March 11 passed House Bill 415 to confirm that locally elected officials retain authority to hire and fire police chiefs and set department policy, and to limit the role of unelected outside bodies in policing governance.
Senator Ibsen, the sponsor, said the bill "gives the power of running police departments within local to the local elected officials" and protects due process for officers. Sponsors described the measure as preventative: in their view, a movement to create unaccountable oversight bodies could hurt recruitment and accountability for local elected officials.
Opponents questioned whether the legislation solves a current problem or preemptively restricts local options. Senator Iwamoto asked whether the bill "doesn't do anything new," and the sponsor agreed it was largely protective of the status quo but argued the legislation was necessary to plug an anticipated problem.
Supporters framed the bill as protecting the accountability chain to voters. Senator Bramble said the measure reinforced the principle that "duly elected officials have the responsibility and the accountability to answer back to the people, not an unelected, unaccountable board to take shots at law enforcement." Senator Reeby said she would vote no because she did not want to restrict potential future local governance options without evidence of a problem.
The Senate passed HB415 by roll-call (20 yeas, 7 nays, 2 absent). The bill will be returned to the House for further consideration.
