Utah Senate approves resolution calling for convention of states after heated debate

The Utah Senate on Wednesday approved a joint resolution directing the state nd its delegates to support a convention of states under Article V of the U.S. Constitution to consider proposals for fiscal restraint and limits on federal power. Sponsor Sen. Todd Vickers introduced SJR9 as a vehicle to press for a balanced federal budget, term limits and constraints on federal jurisdiction.
Supporters argued the resolution is a tool to prompt federal action and that any proposed amendment would still require ratification by three-quarters of the states. Sen. Thatcher said, "I love and support the Constitution of The United States of America" and argued an Article V convention would not by itself change law without broad state ratification.
Opponents warned of unpredictable consequences from opening the Constitution. "It absolutely amazed me that it actually passed the third reading yesterday," Sen. Christiansen said, adding, "It's a dangerous situation ... we're trading on dangerous ground by opening up the constitution." Christiansen and other senators urged caution and opposed the measure.
After more than a half-hour of debate and a call to ensure senators were present for the vote, the Senate recorded 16 yeas, 12 nays and one absence; the resolution passed and will be sent to the House for consideration. The body recorded several members' "explain my vote" remarks on both sides.
What comes next: SJR9 will be transmitted to the Utah House for its consideration. As with all Article V measures, any proposed amendment from a convention would still require ratification by the legislatures of 38 states to take effect.
