The Utah Senate recalled and reconsidered Third Substitute House Joint Resolution 2 (HJR2), a proposal to amend court rules related to injunctions, and passed an amended version on Feb. 10.
Senator McKay, the sponsor, said the substitute removed broader retroactivity in favor of narrower language applying only to statutory challenges and that the change addressed earlier critiques. Senator Weiler noted the amendment resolved many concerns and observed that the Utah Bar had become neutral on the bill following the substitution.
The chamber voted after discussion and recorded the passage of the third substitute version by a roll call of 22 yeas, 6 nays and 1 absent. The resolution will be returned to the House for further consideration.
Senators described the substitute as a procedural clarification intended to reduce litigation uncertainty while respecting statutory boundaries. The record shows the Senate used the recall and reconsideration process to reopen the item and adopt the substitute before final passage.
