The Town of Falmouth Select Board on Nov. 26 voted to amend its prior access determination for 59 Telegraph Hill Road to reflect a Superior Court order that reduces the vegetative clearance height from 15 feet to 13.5 feet. Planning Department staff told the board the change aligns the town letter with the minimum required by the state fire code.
"You're being asked to modify your original determination of access… to eliminate the 15 foot height for vegetative clearance and replace that with 13 and a half feet," Planning Department staff (S5) told the board. S4 and other members clarified that the court remand addresses only that numerical clearance requirement and that the fire department originally supported 13.5 feet.
Board member S4 moved to endorse the change and forward the amended section of the letter to the Building Commissioner; the motion was seconded (S2). The board voted unanimously among those present; the chair noted the result as "unanimous for those of us here" with a recorded 6–0 count in the meeting record. The action implements the court-ordered amendment and directs staff to update and forward the revised documentation.
