Members of the Town of Falmouth Planning Board used the meeting to revisit short-term rental policy in light of recent Massachusetts case law the chair identified as Lynnfield. The chair said the decision treats non-owner-occupied short-term rentals as a commercial use that may be illegal in residential zones, and recommended that the working group examine the case before the board resumes drafting local rules.
"It's called Lynnfield," the chair said, adding that they would distribute a link to the decision to board members and staff. Members agreed there is additional legal work and public engagement to be done before proposing any local amendments. The board noted that town meeting previously declined a short-term rental change and that the Lynnfield ruling adds urgency to understanding legal exposure and options.
The board agreed to continue work on the issue in January and to provide members with case materials so future deliberations are informed by the court's approach to owner-occupancy and commercial use in zoning contexts.
