Planning Board Proposes 'Home-Based Business' Bylaw to Replace Home Occupation; Deletions Simplify Process

FALMOUTH — The Planning Board on Sept. 13 reviewed a streamlined draft that would rename the town’s Home Occupation rules as "Home-Based Business" and reorganize standards into by-right and special-permit tiers.
Staff said the by-right category is intended for low-impact professions such as accountants or attorneys operating from a residence, limited to 30 percent of the principal dwelling’s gross floor area, with restrictions on outward appearance, signage, parking and the number of employees. Uses that exceed those thresholds would require a special permit from the Zoning Board of Appeals.
The draft eliminates a cumulative-impact clause the working group found difficult to administer and clarifies that special permits already required for nonconforming lots or structures do not need duplicate approvals. The working group sought language that balances the property owner’s ability to run a small business with protections for neighborhood character.
Staff said they will add a clearer heading to distinguish items allowed by right from those requiring a special permit and return with redlines. The hearing remains open and the board did not act on the article at the meeting.
