Resident asks Bourbon County Commission to clarify maintenance, threatens legal action over Unique Road

Jesse Walker told the Bourbon County Commission on June 10 that Unique Road — the lane running west of 90 Fifth Street — has been maintained on and off by the county for years but that county staff recently told him the road "was not a county road" and crews would only fix it once. Walker said the county removed the Unique Road sign and that roughly 500 feet of the lane is now considered private, leaving the adjoining property owners responsible for upkeep.
Walker asked the commission to clarify why the county changed its maintenance practice and to provide public minutes or records that show the road’s current legal status. He said that previous county crews bladed the lane when it was dirt and that his family has lived along the road for decades. Walker warned that if the county could not supply documentation, he intended to consult a lawyer.
Commission members said they would review the case with public works staff and the county attorney, and they invited Walker to provide the case law he referenced. The commission’s chair said the county would not ask staff to perform work that legal counsel or county policy prohibits, and that officials would follow up with the public works director and county counsel to determine whether the maintenance practice should continue or change.
The commission did not take formal action at the meeting; staff and legal counsel were tasked to research the maintenance history and applicable case law and report back.
