The Ogden Valley Planning Commission voted Aug. 6 to approve a consent item related to a structure to be sited near Snowbasin, after a brief discussion about whether the county generally requires applicants to include language protecting the public.
A commissioner asked legal counsel whether the county typically inserts language requiring an applicant to 'protect the public from collision' when approving a building in a ski area, citing a past incident in which a skier ran into a pole and was killed. Legal counsel (Corland) replied that adding such a condition "is certainly something that could be considered as an additional condition," and said county liability would generally not be expected; he emphasized the applicant's responsibility for safety decisions.
Because the agenda item was labeled as a meeting item rather than a work session item, counsel advised the commission it could legally take a vote. The chair asked whether anyone wished to move the item from consent to the regular agenda; with no motion to do so, the commission proceeded and the chair summarized the vote as unanimous.
The commission took no additional conditions on the record at the Aug. 6 meeting. There was no public comment on non-agenda items that evening, and the commission then moved on to other business.
