Willard planning panel forwards draft subdivision-regulation revisions to City Council

The Willard Planning Commission voted to forward proposed revisions to the city’s subdivision regulations to the City Council after staff recommended changing when subdivision improvement plans are required.
Staff member (Speaker 3) told the commission that the draft ordinance currently requires subdivision improvement plans — also called construction drawings or "CDs" — to be submitted with the preliminary application to the Planning Commission acting as the ALUA. "As the ordinance sits right now, the...subdivision improvement plans are supposed to be presented with the preliminary plans," Speaker 3 said, adding that smaller applicants may not be able to afford full engineering drawings at that stage. "Someone who wants to split their property and build a home for their son or daughter might not be able to afford that right off the bat, and that is costly," Speaker 3 said.
Because the preliminary application already asks for substantial information — building locations, setbacks, easements, utilities and street design — staff and several commissioners argued the technical construction drawings could reasonably be shifted to the final-application stage. Speaker 3 said an engineer-provided checklist from Chris Breinholtz shows the level of detail staff currently request at preliminary review and informed the recommendation.
Speaker 5 moved that the commission send the proposed revision of the subdivision regulations (referenced in the draft as chapter 12-400 of the Willard zoning ordinance) to the City Council with the conditions discussed; Speaker 4 seconded and the motion passed by voice vote. The commission asked staff to incorporate the suggested clarifications and to deliver the ordinance to City Council in time for the December 12 meeting.
No substantive amendments to the city’s notice or appeal provisions were proposed at the meeting; staff said organization and ordering of the ordinance text would be adjusted for clarity but would not change existing appeal rights. The City Council will receive the draft and decide whether to schedule further hearings or adopt the changes.
