Planning Commission recommends chapter 7 subdivision ordinance changes to Town Council

The Rockville Planning Commission voted on Dec. 10 to formally recommend changes to the town's subdivision ordinance (Land Use Code chapter 7) to the Town Council, following an extended review and page-by-page discussion with staff and references to required state-law updates.

Commissioners and staff reviewed consultant annotations (marked in red/pink in the draft) and debated three principal issues: whether to adopt "harsher" language (for example, where some municipalities use the term "illegal" to describe subdivisions done without town approval), which optional state-recommended provisions to retain locally, and how the town's land-use authority should be identified across chapters. One commissioner urged keeping local provisions for minor subdivisions and agricultural subdivision language; another recommended cross-checking references to county jurisdiction for lot-line adjustments.

Specific clarifications discussed included the town's notification timeline (the draft required 10 days per state law; existing town code used 14 days), the desirability of keeping a minor-subdivision process that the commission finds useful, and retaining locally important design and code sections instead of deleting them. Commissioners noted that some language is mandated by state law and that other annotations were optional; several pink-marked edits were kept while a small handful were crossed out or left unchanged.

A motion to recommend the chapter 7 changes to the Town Council with the Planning Commission'noted edits carried in a roll-call vote. Commissioners said the recommendation is necessary so the council can act to make the town code compliant with state law and preserve the commission's locally valued provisions. The recommendation will be delivered to the Town Council at its next meeting.
