Grantsville tables two automotive conditional-use requests and moves to add wholesale-dealer use in MD zone

During its Dec. 5 meeting the Grantsville Planning Commission considered three separate automotive-related land-use requests and took different actions based on zoning and legal constraints.
Richard's Tires / Stevens/Steven Richards: The applicant described plans to operate a small tire-repair and replacement business at 148 Southwest Street, citing parking and a nearby hydrant as mitigating factors for safety and fire concerns. Neighbors said an automotive operation in a residential RM-7 area would set a poor precedent. Staff advised that tire repair is not a permitted or conditional use in RN/RM-7 zones in the current code and reminded the commission that similar uses had sometimes been allowed previously by council in other locations. Commissioners who favored the concept nonetheless expressed concern about the legal basis to approve uses not listed in the code and voted to table the matter so counsel can provide definitive guidance.
Elmer Automotive / Caden Elmer (23 West Clark Street): Similar legal concerns arose about an automotive repair and maintenance business in RM-7. Neighbors raised compatibility concerns and commissioners again voted to table the request pending counsel review and potential code changes or a council-level decision.
AGX Automotive / Wyatt Labrum (292 N. 138 Highway, MD zone): The applicant described a gated, appointment-only wholesale operation with limited on-site inventory. Staff and commissioners discussed whether a wholesale automotive-dealer use should be included as a conditional use in the MD zone; the commission directed staff to prepare public notice to add that conditional-use category and to pursue the code amendment/council review necessary to allow the use.
What happens next: Items concerning uses not listed in the code were tabled pending legal review; staff will prepare notice to allow the wholesale-dealer conditional-use in the MD zone and bring the item forward for public notice and eventual council action if appropriate.
