The Grantsville Planning Commission on Dec. 5 voted unanimously to move an ordinance package that would remove the city's existing Planned Unit Development (PUD) language in the Land Use and Management Code to the action phase for final consideration.
Commissioners and a public commenter who supported the repeal said the current PUD code appeared outdated; several commissioners and staff cautioned that repealing PUD language should not erase protections typically included in a master development agreement (MDA) such as utility upgrades, off-site improvements and open-space commitments. Commissioner comments and a public speaker urged staff to ensure MDA-like protections remain codified elsewhere in the code or submission process.
City attorney Jay explained that while removing the PUD framework alters the review pathway, land-use deviations or density changes would still require application, public notice and the legislative process under state code. Jay also said staff will look for references to PUD-related provisions throughout the code so that necessary protections can be preserved in other chapters or the application process.
The motion to move the amendment package to an action item was seconded and passed unanimously; the commission then voted unanimously to approve the package as an action item and forward it for the next steps required by the municipal process.
What happens next: staff will reconcile references to MDAs and other PUD-related provisions across the code before forwarding final language toward city council for legislative action.
