Fairfield Town Council on Dec. 18 voted to approve a resolution and three ordinances that update local planning and development rules.
Resolution R2024-25: The council voted to consent to the transfer of title for a parcel involving the Alpine School District and a state freeway alignment. The resolution was introduced and moved by a council member (speaker 2) and seconded by another member (speaker 6); the motion passed by voice vote with council members on the record voting in favor.
Ordinance 2024-12 (subdivision ordinance): Council deliberated amendments to chapter 10.15 of the town code. Members discussed phasing language and specifically agreed to remove airpark-specific provisions pending clarification of ownership and need. After the edits the council approved the ordinance with the changes discussed.
Ordinance 2024-13 (soil ordinance): Council reviewed language clarifying soil-testing requirements and debated whether subdivision-level testing should relieve repetitive lot-level testing at building permit stage. Council directed staff to add clarifying language so that subdivisions tested as a whole would generally not require duplicate tests at each building permit; the council then approved the ordinance as edited.
Ordinance 2024-14 (ADU regulations): Council approved amendments to ADU rules (chapter 10.11 and related code sections), including insertion of a subsection discussed at the meeting to clarify proximity requirements between an ADU and the primary dwelling (discussed in meeting as a 200-foot proximity standard). Staff was asked to add the specific new subsection before finalizing the ordinance.
Votes at a glance (as recorded in the meeting): - Resolution R2024-25: motion by Speaker 2; second by Speaker 6; recorded roll-call/voice: "R L, yes; Tyler, yes; Michael, yes; Paul, yes; Richard, yes." Outcome: approved. - Ordinance 2024-12: motion by Speaker 2 (with agreed edits removing airpark language); second by Speaker 6; recorded voice votes included "Yes" from several members and the motion carried. Outcome: approved with edits. - Ordinance 2024-13: motion to approve with edits; second recorded; voice vote recorded as 'yes' by members present. Outcome: approved with edits. - Ordinance 2024-14 (ADU): motion by Speaker 2; second by Speaker 6; council approved the ordinance with the agreed insertion (staff to add item 9 to section d clarifying ADU proximity).
Council members said the changes are intended to ensure clarity for applicants and planning staff and to avoid unintended consequences (for example, forcing repetitive soil tests or locking in airpark language before ownership and operational details are finalized). Staff and the town attorney (Todd) were asked to prepare the final ordinance text incorporating the edits.
What happens next: Town staff will finalize ordinance language to reflect the council's edits and file the approved resolutions/ordinances in the town record. Planning staff will implement the updated review steps for plats, soil testing and ADU applications.
