Council approves conditional use for Wayne County clinic and a barndominium building permit; planners urge clearer conditional-use rules

Jim, speaking for planning and zoning, reported on a conditional-use permit application for a Wayne County clinic and recommended conditions including a flood-mitigation plan, a lighting plan that does not invade surrounding properties and a landscaping plan. Planning staff and commissioners also recommended explicitly listing 'medical facility' as a condition so the approved use cannot be converted later into a nonmedical commercial use. Council voted to approve the conditional-use permit with the additional condition that the new building remain a medical facility.
The council also reviewed and approved a building permit for Michael Elliott to convert part of an existing barn into a two-story, two-bedroom apartment of about 1,300 square feet. Staff advised the community that accessory-dwelling-unit (ADU) rules limit ADU size to 800 square feet and that the proposed unit exceeds that limit; options discussed included subdividing the property into two half-acre lots and providing separate septic and utility hookups if the applicant wishes to retain both dwellings.
In broader discussion, planning commissioners highlighted confusion between rezoning and conditional-use applications: a conditional-use permit does not change the underlying zoning and the town’s application forms used similar wording for both processes. Jim recommended revising ordinance language to list allowed conditional uses (for example: government offices, clinics, hospitals, churches, schools and similar institutional uses) and to tighten application and notification procedures so future applicants and neighbors are not confused.
