City staff presented a Title 41 Planned Unit Development application for 34 Elliott Street and told the Athens Planning Commission a full site plan is not yet available, complicating the commission’s review.
"We don't have, at this point, don't have a site plan yet, but we do have a floor plan that's in your packet," said David Riggs, the staff member who introduced the project. He added the developer proposes off‑site parking on an adjacent lot owned by the same person and indicated that the project previously received a zone change approved by the commission and city council.
Commissioners pressed for more detail. One commissioner said a floor plan alone is insufficient for internal review and noted Title 41 rules require a two‑week posting period before the project returns for a hearing; without prompt submittal of a site plan the case likely cannot be heard at the next meeting. Another commissioner raised elevation and floodplain concerns, saying 34 Elliott appears "significantly below the hundred year flood plain" and that regulations requiring finished floors above base flood elevations could limit zero‑grade entries for accessible units.
The developer, represented at the meeting by Mister DeLuca, did not present a site plan but indicated the architect (Richard Schulz) could provide further materials. Riggs and a commissioner urged the applicant to provide a complete site plan — including parking deed restrictions, finished floor elevations and accessibility details — before the commission schedules a vote. The developer noted ramping and ADA compliance will be considered during design, but specifics were not yet in the record.
The commission did not vote on the Title 41 application. The chair said the earliest the case could return is two weeks but that timing depends on receiving a complete site plan and satisfying the posting requirement.
