Council approves ordinance allowing outdoor dining on Nassau Street pending NJDOT approval

Princeton council voted to add state and county right-of-way to the local outdoor dining ordinance so restaurants can obtain sidewalk dining permits on Nassau Street once NJDOT grants occupancy approval.
The Princeton mayor and council voted on Dec. 9 to amend the borough code so outdoor dining licenses may be issued on sidewalks under county or state jurisdiction when the New Jersey Department of Transportation grants occupancy permission for Nassau Street.
Jim, the municipal engineer, summarized the change as adding state- and county-controlled right-of-way into the existing outdoor dining ordinance so the municipality can quickly issue permits once NJDOT approval is received. He said the ordinance is a preparatory measure: "we want to be prepared to be able to issue permits for outdoor dining licenses on Nassau Street as soon as that approval comes in from the State of New Jersey Department of Transportation."
Council members thanked staff and engineering for negotiating with the state and noted Councilwoman Perron Lambros— leadership on the project. There were no public comments in-person or on Zoom during the hearing. The ordinance passed on a roll-call vote; the transcript records affirmative votes from Perron Lambros, Eve Niedergang, Cohen, Sachs, Fraga and Newland.
The amendment does not itself change use until NJDOT grants the sidewalk occupancy permit; the council motion prepares local permitting procedures to follow that external authorization.
