Board closes public hearing on Cummings Road right-of-way vacation after no opposition reported

The Linn County Board of Supervisors opened and then closed a public hearing to consider vacating a 470-foot right-of-way on Cummings Road.
Curt Logan, assistant engineer for Secondary Roads, told the board the office had not received any opposition and that the neighbors who would receive the vacated right-of-way "are in favor of it." He said staff were willing to proceed with the vacation.
A county staff member confirmed proof of publication was on file, but also explained that one public hearing had been delayed earlier because a legal notice had been incorrect; as a result, staff said a resolution to vacate would be prepared and brought back to the board.
After those remarks the chair moved to close the public hearing, the motion was seconded and the board voted to close the hearing. No formal vacate resolution was adopted at this meeting; staff indicated a resolution would follow once legal-notice issues were resolved.
