Fate council approves several ordinances including zoning for donut shop and tattoo studio; consensus on utilities changes

The Fate City Council approved several routine and land-use items in its October meeting, voting to adopt a consent agenda and multiple ordinances that the city said align with its development plans.
Council approved the consent agenda after brief questions about updates to the financial-management and purchasing policies; staff said some technical procedures were moved from ordinance into administrative policy to allow faster updates. The motion to approve was recorded as "motion passes 6 0 1."
On zoning matters, the council approved Ordinance O-2024-055, a zoning map amendment (case ZR24008) that changes a 0.16-acre parcel from Agriculture to Neighborhood Commercial to allow a donut shop with a pickup window. Ryan Wells, director of planning and development services, told the council that notices were mailed to six neighboring properties and the Planning & Zoning Commission recommended approval. Wells said the parcel—s projected taxable value at completion is a little over $300,000 and estimated annual property-tax revenue of about $600; because baked goods are exempt from state sales tax under the state tax code cited by staff, no sales-tax revenue was forecasted. The ordinance was adopted with no public opposition recorded.
The council also approved Ordinance O-2024-056, granting a specific-use permit (SUP24004) to Sticks and Stones tattoo studio to occupy Suite 1500 at the Glory Center. Staff said 12 mailed notices and a published notice were sent and no responses were received. Applicant Madison Owens Wolteridge told the council the business had to relocate after a prior lease fell through; council members noted the SUP is location-specific and the ordinance includes language allowing the city to initiate expiration of the SUP if the tenant vacates.
Council adopted Ordinance O-2024-057 to update Chapter 30 (utilities) and an associated standard operating procedure. Staff explained the city moved technical details (for example, deposit-refund mechanics) from ordinance text into an SOP that the city manager will administer. City staff said the utility system now serves over 9,000 accounts, and discussed a proposed 12-month notification process for making customers eligible for deposit refunds and a small number of citizen-requested meter tests (six in the 2020–2024 period, with one failure). Council approved the ordinance.
The council postponed action on a separate capital project item concerning Miss May Drive to the Nov. 11 meeting at the request of the city attorney.
The meeting adjourned after council completed its agenda.
