Kingsville — The commission approved Change Order No. 1 to a GLO CDBG‑MIT manhole rehabilitation contract that reduces the contract price by $4,800 while increasing the contract completion time by 136 days.
Staff explained the change order is intended to help close out the grant and that the final contract price after the change is $468,506.40 and the final contract time is 256 calendar days. "This change order number 1 will decrease the contract price by 4,800 and increase the project contract time by a hundred and 36 days," staff said.
A commissioner pressed whether the city was giving up liquidated‑damages collection rights by granting the extension, saying, "are we getting the same value of the number of days that we're given on that $4,800?" Staff responded that pursuing liquidated damages requires proving noncompliance and that several reasons—such as rain days—made the extension reasonable.
Commission action to approve the change order passed unanimously by roll call. City staff characterized the change as primarily administrative to comply with grant end dates and to avoid potential grant noncompliance.
