Concord Natural Resources Commission approves multiple permits, sets continuances and issues enforcement direction

The Natural Resources Commission met in a hybrid session and issued several permit decisions while setting follow-up actions for pending projects.
The commission voted unanimously to continue two hearings: DEP file 1371647 (311 Garfield) to Oct. 1 and DEP file 1371641 (154 Southfield Road) to Nov. 6. It approved an order of conditions for Middlesex School’s new athletic center (1400 Lowell Road, DEP file 137-1674) with standard conditions 1–20 and special conditions 21–58. The applicant was told the signed order would be available for pickup the next day and the appeal period is 10 business days.
Staff and applicants reported revisions addressing peer-review comments for other projects. The commission issued an order of conditions for DEP file 137-1677 (220 Walls Hill/220 Ballzale Road) after the applicant confirmed planting, invasive-management and tree-protection revisions. Two RDAs received Negative Determinations: Comcast (RDA 24-12, 1024 Main Street) for cable repair with pre-construction and post-completion conditions, and 1629 Lowell Road (RDA 24-13) for in-ground native tree plantings; in the latter case the transcript shows the pre-construction conference condition was recorded as met.
In enforcement and compliance actions, the commission approved a Certificate of Compliance for work at 68 Commonwealth Ave (Concord Park, DEP file 137-1452) after staff reported the intended erosion improvements were achieved. The commission reappointed Bauke Nordish to the Trails Committee through May 31, 2027, and approved Marshall Farm’s request to remove two hazardous white pines and to install a 36x24-foot hoop house on municipal land, with a plan to replant oaks elsewhere on the farm.
Finally, the commission voted to have staff draft a letter of support for a proposed Recreation Commission Community Preservation Committee application to fund a Jerome Park phase-2 design study for potential water access, a natural playground and related features. Commissioners asked applicants and project teams to submit requested plan revisions and narratives by the deadline set for next Friday so items could be reviewed at the commission’s Oct. 1 meeting.
