The Summerset planning board on Oct. 7 recommended that the board of commissioners deny a property owner’s request to be exempted from annexation, and forwarded several variances and a minor plat to the commissioners for final action.
Planning staff opened the hearing on a voluntary annexation and zoning request for nearby Black River LLC and then moved to consider items carried over from the Sept. 10 meeting, including a non‑annexation variance and multiple relief requests tied to a single property. Staff told the board that adjacent parcels had been zoned C‑1 general commercial and that landowners had been notified.
The property owner told the board he had longstanding survey and boundary issues, described an existing dwelling and accessory structures, and said he sought variances so he could "bring my property up to standard." Neighbors and road‑district representatives contested the relief. Phil Olson, who said he represents the Pine Valley Road District, urged the board not to support the non‑annexation variance, arguing it "does not provide for proper and orderly growth" and would be a way to bypass Summerset design criteria. Resident Iris Olsen and others said the parcel currently contains multiple trailers and buildings and raised concerns about permits and the number of dwellings.
Planning staff and a board member clarified that denying the non‑annexation request would mean the property would be subject to Summerset ordinances if the board of commissioners adopts the planning board’s recommendation; staff noted that R‑1 zoning would not allow a mobile home and that septic size, kennel permits and other standards could apply. After discussion, the planning board voted to recommend denial of the non‑annexation variance and forwarded that recommendation to the board of commissioners for final action.
On related items, the board recommended approval of several variances tied to existing conditions on the parcel. The board voted to recommend approval of reduced setbacks for an existing garage (6.2 feet) and a shed (2.1 feet), and to recommend approval of a shared‑driveway access variance. An HDR engineering review (dated Aug. 14) was cited during discussion about an interior minor drainage and utility easement; staff advised the board that easement language and engineering notes would be added to the plat when recorded. Public commenters raised questions about detention, septic capacity and whether design criteria were being applied consistently.
The planning board also recommended approval of a minor plat (lot‑line adjustment) but made that recommendation contingent on the property being annexed and meeting referenced requirements (septic/permitting/engineering) before final recordation. Staff and board members repeatedly noted that the planning board’s role is advisory and that the board of commissioners will make the final decision on annexation and the related land‑use approvals.
