Exeter council adopts emergency ordinance to allow temporary acting zoning inspectors
Summary
After the elected zoning inspector was incapacitated in an accident, the Exeter Town Council unanimously adopted an emergency ordinance authorizing the council chair to appoint one or more acting zoning inspectors temporarily to fulfill statutory duties.
Following reports that the town’s elected zoning inspector suffered a serious injury and is currently incapacitated, the Exeter Town Council adopted an emergency ordinance to permit the appointment of acting zoning inspectors.
The ordinance, read into the public record by the council, cited sections of the Home Rule Charter giving the council authority to act in a public emergency and explained that the town charter is silent on temporary incapacity of an elected zoning inspector. Under the emergency measure the council chair will have discretion to appoint qualified acting inspectors, who need not be registered electors, to exercise all powers and duties of the office for up to 60 days (unless extended) or until the elected inspector declares in writing he is able to resume duties.
Council opened a public hearing on the ordinance and heard questions about posting and qualifications; staff confirmed acting appointees must be qualified by education or experience and the council may discharge them by majority vote. The motion to adopt the emergency ordinance passed by voice vote.
