Council postpones conditional-use hearings for towing business and outside storage until Nov. 4; applicant required to attend

The Mitchell City Council, acting as the Board of Adjustment, postponed consideration of two conditional-use permits tied to property owned/occupied by Josh Frost. Council moved to delay both the request to operate Mitchell Towing and Recovery at the Sixth Avenue site and a separate conditional use for outside storage until the Nov. 4 meeting, with one postponement conditioned on the applicant's attendance.
Jeff Matheep of Davis County Planning and Zoning told the council the site is in the city's extraterritorial jurisdiction and is identified in the comprehensive plan as residential; he said residents had returned letters of opposition and that the property had not been brought into compliance despite prior deadlines. Matheep said the planning packet included three returned letters opposing the applications and that the applicant's earlier cleanup plan was inadequate.
Derek Davis, owner of Mitchell Towing and Recovery, spoke on behalf of Josh Frost and said the towing business portion had moved to a new, properly zoned location; he asked for one week to finish fencing and remove vehicles. The applicant (Josh Frost) submitted an update by email and said he planned to clear the yard by August 2025 and hold an auction in spring 2025 to reduce stored materials.
Councilmembers and planning staff reported mixed evidence of progress. Several members said they had expected to see more tangible improvements since the previous review and cited concerns about the property continuing to appear as a "junkyard" in a primarily residential area. On that basis, a motion to postpone both conditional uses to Nov. 4 carried; council also specified Josh Frost must appear at the Nov. 4 hearing for the outside-storage item.
Next steps: Both conditional-use items remain pending and will return to the council/Board of Adjustment on Nov. 4, when the council expects the applicant to answer questions in person.
