Manor council authorizes city manager to finalize wastewater easement after parties confer

The Manor City Council voted to approve a wastewater easement and authorized the city manager to finalize and execute any necessary revisions after parties and staff worked through last-minute technical issues.

Assistant City Attorney Veronica Rivera told the council that a new exhibit changed the acreage in the easement and that "the posting on the agenda is not correct now for you to actually take action on that item," prompting staff to recommend postponement to Dec. 18 unless council authorized administrative execution. Representatives for the developer and the adjacent property owner said corrected documents arrived only that day and asked for more time to confirm engineering details.

Josh Vasquez, representing the adjacent landowner, said the easement "was initially drawn wrong" and the developer received updated materials the same day; he asked the council to postpone so engineers could review the changes. City engineering presented two feasible alignment alternatives: an elevated creek crossing that would leave the wastewater line about a foot above the creek bottom and a route around a pond whose feasibility depends on box culvert elevations the developer had not yet supplied.

Interim development staff said the easement is required by the plat and that delays could hold up construction. After parties met outside the chamber and staff provided updated analysis, the council approved the 0.6399-acre wastewater easement "as to form" and authorized the city manager to execute the document with any necessary revisions so work can move forward without waiting for the next council meeting.

The vote came after council weighed two options — postponement for rewording and re-noticing, or administrative authorization — and chose the latter to avoid further delays to the development's schedule. Staff said the city would still complete any needed revisions and return final paperwork for the record if appropriate.
