Eagle Pass planning commission approves Pilot Commercial Subdivision plat with conditions

The Eagle Pass Planning and Zoning Commission approved a final plat for the Pilot Commercial Subdivision after a staff presentation and a brief commission exchange.
Staff described the proposal as a direct-to-final plat for a 28.56-acre parcel at the intersection of El Indio (FM 1021) and Loop 480, across from the Stripes station, to be divided into eight industrial lots including a corner lot planned for a Pilot truck stop. The application seeks a subdivision variance to bypass preliminary-plat infrastructure installation and a sidewalk waiver for interior streets.
Under the direct-to-final process, the commission may accept a final plat before public improvements are installed if the developer provides a financial guarantee and a construction agreement. Staff said the developer or future buyer (Pilot) will provide the required guarantee to assure completion of streets, water and other utilities.
Staff reported that City departments — Public Works, City Engineering and the Fire Marshal — have reviewed and approved the plat, and that TxDOT approval has been secured. Eagle Pass Water Works approval is pending execution of a 30-year wastewater agreement scheduled for consideration at its next meeting; AEP utility consent also remained pending. Staff presented an engineer’s cost estimate of $2,574,000 for the public improvements; the financial guarantee must cover those costs.
On sidewalks, staff recommended only a partial waiver. Interior streets such as Queens Court could be exempt from sidewalks given the industrial zoning, but staff said sidewalks should be required along the major perimeter corridors on FM 1021 and Loop 480 because those are potential direct paths between residential areas and services.
Commissioners moved to approve staff’s recommendation to grant the subdivision variance from preliminary-plat requirements, partially approve the sidewalk waiver, and grant final plat approval subject to compliance with Eagle Pass Code of Ordinances Chapter 23 and the conditions listed by staff. A member announced an abstention prior to the vote; the motion carried.
Conditions placed on the approval include provision of an acceptable financial guarantee and construction agreement before plat recordation, execution of the 30-year wastewater agreement with Eagle Pass Water Works before recordation, payment of applicable Eagle Pass Water Works fees, and obtaining AEP consent. Staff said those items must be satisfied before the city will record the plat.
Next steps: the Eagle Pass Water Works board is scheduled to consider the wastewater agreement at its next meeting; staff will return when the financial guarantee, wastewater agreement and utility consents are in place and the plat is ready for recordation.
