Mayor Salinas and the Eagle Pass City Council approved on Nov. 5, 2024, an ordinance to abandon an approximately 1.46-acre easement along Industrial Spur 2 Boulevard after a public hearing and a Planning & Zoning Commission recommendation.
The action follows a petition submitted by Paco Mondragon (listed in hearing materials as associated with Immer Mex LLC) to remove an easement described in deed records for Maverick County (referenced in the hearing as recorded in volume 244, page 146). A city staff member told council that notices were mailed to abutting property owners and that no opposition was received.
A presenter who addressed council as part of the hearing said the easement should have been formally abandoned when the nearby Bridge 2 plat was recorded and characterized the council action as a historical "housekeeping" step to allow the owner to consolidate and record the parcel. The property in question was described by staff as industrially zoned; access to the site is provided by Industrial Boulevard/Industrial Spur 2.
"This should have been done when Bridge 2 was platted," the presenter said, explaining that the right-of-way remained on plats and was never formally removed, which prevented consolidation and recording of the parcel.
Following the presentation and public hearing closure at 5:40 p.m., Mayor Pro Tem Davis moved to approve the Planning & Zoning recommendation; Councilman Garcia seconded. The motion passed with four council members voting in favor and Councilwoman Cruz abstaining. Council directed staff to prepare and adopt the ordinance as petitioned.
The council did not record any public opposition during the hearing. The ordinance text and the formal abandonment record will be prepared by city staff for subsequent publication and recording in the Maverick County deed records.
No additional budgetary commitments were reported during the hearing; staff described the item as a property-recording action tied to platting history. The council moved on to other business after the vote.
