The presentation explained that a 200‑square‑foot fiberglass pool is counted as half area (100 sq ft) for the purposes of accessory‑structure calculations; combined with an existing 435 sq ft concrete patio, a proposed 160 sq ft flatwork area and a 600 sq ft deck, staff calculated total accessory coverage that could exceed code thresholds unless the applicant trims proposed impervious areas or accepts conditions.
Staff also flagged stormwater as a concern because the lot slopes toward the southwest corner and recommended that the applicant provide a best‑management practice (BMP) solution — e.g., rock bed, mulch berm or a small cistern/retention basin — at permit application. Staff noted the lot is legally nonconforming with a width of about 75 feet.
Lawrence Otte, contractor for the applicant, said he would pull the pool slightly closer to the house (reducing the proposed flatwork by roughly 2 to 2.5 feet), use a Trex deck over rock bedding and install a water‑retention basin in the low corner to address runoff. Staff said they would work with the applicant to identify reductions or alternatives to bring coverage into compliance.
Commissioner Daniel Rosenberg moved to authorize approval of the petition for site‑plan/community‑design and concept stormwater review for the 200 sq ft fiberglass pool (counted as 100 sq ft for code), 600 sq ft deck and 160 sq ft flatwork as presented in the June 6 memorandum, subject to staff conditions; Commissioner Spiegleglass seconded and the motion passed 5‑0. Staff advised the applicant to submit building‑permit materials for review.
