Panel flags constitutional questions as lawmakers consider Department of Energy and Environment

Lawmakers in the Senate State Agencies & Governmental Affairs committee discussed House Bill 1215, a consolidation proposal to form a Department of Energy and Environment by combining the Department of Environmental Quality, the Public Service Commission (PSC), pollution-control and other entities.

Senator Hickey told the committee he had found judicial commentary suggesting the PSC operates as a legislative agency and urged staff to study whether transferring it to the executive branch is constitutionally permissible. "It appears like ... the public service commission is ... a legislative agency," he said, asking the bill drafters and staff to examine relevant Supreme Court language.

Committee staff said they had not previously encountered the argument in this detail and agreed to follow up. Members also discussed appointment and confirmation language across the transformation bills, asking whether director-level posts would require Senate consent and whether commissions would become dominated by state employees under the new structure. Staff said some early draft language will be brought into consistency in the final version and that changes in earlier drafts may be corrected.

Senator Keith pressed whether composition changes could create a majority of state employees on certain commissions. Staff acknowledged the concern and said they would review appointments language with the governor’s office and legislative counsel.

No final committee vote was taken on HB 1215. Members asked for additional legal research on the PSC’s status and for consistent drafting across related bills before the committee considers final action.
