The Gardner City Council accepted a voluntary consent annexation request from CF Gardner LLC and adopted Ordinance No. 2818.
City staff described the request as an agreement to annex about 86.24 acres on the northeast corner of 170th and Claire. The voluntary annexation agreement presented to council includes a de‑annexation clause allowing the property owner to de‑annex if the parties cannot reach terms in a separate pilot agreement tied to a development/pilot agreement that will be brought back to the council on Jan. 21.
Staff said funding for arterial road upgrades that had been described in the packet as a benefit district was instead negotiated to be addressed in the pilot agreement and the development agreement terms; council members asked for clarification on how on‑premises road improvements and arterial contributions will be handled and staff said those terms will be included in the pilot agreement.
Kurt Peterson, the developer’s attorney with Postonelli, was present for questions. Council moved, seconded and adopted Ordinance No. 2818 accepting the voluntary consent annexation request; the clerk recorded affirmative votes and the ordinance passed.
Staff indicated the pilot agreement and related development terms will be returned to council for final approval on the timeline discussed in the presentation.
