Gardner Planning Commission approves Lone Star Prairie first plat, 6-0

The City of Gardner Planning Commission on Sept. 23 approved the final plat for Lone Star Prairie First Plat, a roughly 48-acre subdivision phase that staff said includes about 17 acres of buildable lots. The commission’s approval, made by Commissioner Mader and seconded by Commissioner Sosa, was unanimous (6-0) and is recommended to the governing body subject to meeting items 1–3 in the staff report dated Sept. 18, 2024.
The plat had been rezoned and approved at the preliminary stage on Dec. 19, 2023, and the governing body approved the rezoning ordinance on Jan. 16, 2024, staff said. In a presentation, staff described the phase as including 66 lots and four tracts, to be served by the City of Gardner electric system and Sanitary Sewers; Water District 7 was identified as the water service provider. Staff recommended approval, saying the application is “generally consistent” with the comprehensive plan in use as a guide rather than an ordinance.
At the meeting, developers’ representative Degan Hahn of Circle H Land Development thanked staff and said, “We’re excited to be here in Gardner,” and that the applicant will pursue City Council action on Oct. 7. Commissioners focused questions on utilities and infrastructure. Staff explained the planned lift station will be placed on Tract D (an undeveloped portion) with easements created to allow construction and access; the long-term intent is that, once constructed and accepted by inspection, the utilities department will own the lift station and the developer will deed an appropriately sized tract for maintenance access. Staff said that if a later phase is not platted within the timeline established in the conditions (the staff report describes a deed condition if phase two does not occur), the developer would be required to deed the area around the lift station to the city so utilities can perform maintenance.
Commissioners also requested confirmation that oil wells on the property had been properly plugged. Staff said the developer provided a letter from a Kansas state agency (identified generically in the record as the state agency that signs off on well plugging, e.g., KDHE) showing sign-off; the planner could not recall the exact agency name on the record but confirmed that state sign-off for plugging wells is required. Stormwater plans were reviewed and approved by Public Works, staff said; final grading and detention-basin design will be completed in the final development plan stage and supported by a stormwater report that determines detention sizing and depth.
The commission approved a routine consent agenda at the start of the meeting, including minutes from Aug. 26, 2024, by unanimous vote (6-0). Staff also warned commissioners of a potential change to the November meeting date because of publication timing and related council actions; staff said they would finalize and notify commissioners.
The planning commission’s approval forwards the Lone Star Prairie First Plat to the City Council for final action; staff conditions listed in the Sept. 18 report must be satisfied before final acceptance of dedications and easements.
