The Carter County Commission on Monday authorized county staff to submit an application to the State for a historic right-of-way easement along Durham Road.
County counsel explained that the board's action would authorize submission of the application, not the state's final approval. After a short presentation on the alignment and historical mapping, Commissioner (Unidentified Speaker 9) moved "we accept the application for the historical right of way easement for Durham Road on the state land application," and the board voted "aye" without public comment. The chair declared the motion carried and instructed counsel to file the application on the county's behalf.
The discussion included questions about two creek crossings and culvert needs; county road staff estimated culvert and crossing costs could range from about $40,000 to $80,000 for large crossings and noted additional gravel and rock would be required to complete the alignment. Counsel advised that the state would rely primarily on the court's prior ruling in this matter and that historical maps were included in the application to document long-term use.
The application now proceeds to the State for review and any conditions the state may attach. The commission did not set a funding appropriation as part of the authorization; any construction or easement-related spending will be subject to future budgeting decisions.
