Rutland planning commission asks Select Board for clarity, timeline on state Act 181 work

At its Sept. 12 meeting the Rutland Town Planning Commission spent substantial time reviewing recent state legislation and how it interacts with local bylaws. Chair (Speaker 1) summarized the impacts of Act 181 and related changes to Act 250 (referred to in the meeting as Act 250/Act 2 50), noting new tiered criteria that could change municipal responsibility for permitting and resource mapping. “This is where you are exempt from all Act 250 permitting if you meet tier 1A,” Speaker 1 said while outlining the prerequisites for tier eligibility.

Commissioners identified four priority tasks — subdivision bylaws, river corridors, streets and sidewalks, and the Act 181 housing rules — and debated sequencing, staffing and the time required to complete them. Several members urged a focused plan and recommended the Select Board provide a clear charge and timeline so the commission can prioritize work efficiently. "My motion is to ask the Select Board to tell the Planning Commission what they expect us to do regarding Act 181 and by when," Speaker 2 said when making the motion.

The commission voted in favor of charging the chair to request formal direction from the Select Board; the motion passed with an affirmative voice vote. Commissioners discussed the likelihood that some pieces of local work (for example subdivision bylaws and the river corridor ordinance) would need to be finished or substantially advanced to qualify the town for certain state tiers.

Next steps: the Commission will forward a request to the Select Board seeking a formal charge and timeline on Act 181 work and will continue work on subdivision bylaws and the river corridor ordinance as parallel tasks.
