The White House Board of Mayor and Aldermen on motion approved Resolution 24-16 establishing a published stormwater enforcement response plan after staff said an audit found the municipal code needed updated language.
City staff told the board that the enforcement response plan had been removed from the ordinance text and provided as an appendix so penalties and procedures would be visible to the board and public. Staff said some of the changes were driven by recommendations from the Tennessee Department of Environment and Conservation.
Board members raised questions about who is most likely to be cited and whether the fines were sufficiently punitive. One board member said modest fines such as $100 could be ineffective; staff responded the local maximum penalty is $500 per violation per day and that fines can accumulate for ongoing violations. Staff also pointed to repeat-offender provisions incorporated in the plan.
After discussion the board moved, seconded and voted to approve Resolution 24-16 and to proceed with first-reading code amendments removing the enforcement response plan text from Title 18 Chapter 4 and replacing it with the updated plan as an appendix.
