Tiverton schedules Nov. 25 public hearing on zoning special-use timing

The Tiverton Town Council voted Oct. 28 to advertise and hold a public hearing on Nov. 25 on an amendment to Appendix A, Article 16 of the Zoning Ordinance that would extend the period governing special-use permits.
Staff and planning-board representatives said the planning board has been working for months to draft standards for numerous special-use permit categories. Under a recent change in state law and the town’s interim action, certain uses that lacked specific criteria would otherwise convert to permitted uses as of Jan. 1, 2024. The proposed amendment extends the not-permitted status through Dec. 31, 2024 to give planners time to finish criteria and avoid unintended conversions to permitted status.
Councilors discussed the statutory advertising window and calendar constraints—including Thanksgiving week—and confirmed the town must advertise for 21 days prior to the hearing. After weighing scheduling options, the council voted to advertise and schedule the public hearing for the Nov. 25 council meeting. Councilors noted that if the planning board does not complete the criteria in time, the new council may have to address outstanding items in December.
The hearing will allow public comment on the zoning amendment and any eventual ordinance would return to the council for final action at a subsequent meeting.
