The East Greenwich Town Council on Oct. 28 extended a previously granted-but-not-issued transfer of a Class B alcoholic beverage license for 5702 Post Road (the Wayside or Grill) to Ocean Breeze Cuisine LLC through Nov. 30, 2024, subject to full compliance as determined by the town clerk.
The request came from attorney David M. D’Agostino, who said Ocean Breeze Cuisine purchased the business and needs time to secure outstanding documentation including a Division of Taxation letter of good standing and a retail sales‑tax permit. D’Agostino said some required items are controlled by the seller and described the current situation as mostly complete but dependent on final clearances. “We do anticipate that we will have these clearances wrapped up very shortly,” D’Agostino told the council.
Town Clerk Lee Carney told the council she had received tips certifications for current and new employees and that most local approvals were satisfied, but the Division of Taxation clearance and a liquor‑distributor confirmation remained outstanding; she also noted that the liability insurance on file expires Dec. 29 and must be renewed. Councilors discussed procedural options if materials were not received by the deadline, including letting the existing owner’s license lapse back to the town and handling renewal or transfer in the ordinary course.
Council President Mark Schwager moved the extension; the motion was seconded and carried on a recorded vote (the transcript records the outcome as 3 to 0). The extension was approved “through 11/30/2024, subject to full compliance as determined by the town clerk,” per the motion.
Next steps: If the required clearances are filed and accepted by the clerk before Nov. 30, the clerk may finalize the transfer without the applicant returning to the council; if not, the application may not proceed under the town’s process and the license could revert to the town for future application.
