Glynn County approves Majestic Oaks PD text revision after exchange over historic family cemetery

The Glynn County Board of Commissioners approved ZM-24-20 on Oct. 21, a text revision to the Majestic Oaks planned development that reduces minimum lot sizes and allows the subdivision of units into fee-simple lots for sale. Planning staff said the amendment does not change the overall density (16 units per acre) but reduces the minimum townhouse lot from 2,000 to 1,600 square feet and reduces the single-family lot minimum from 6,000 to 3,600 square feet.
Planning and zoning staff (Stephanie Leaf) told the board the property has been through prior site-plan approvals and that the current amendment primarily adds right-of-way adjustments and lot lines to enable sale of individual units rather than rental ownership. Leaf also identified a historic Scarlett family cemetery on the property and said that the cemetery is a separate, flagged parcel.
Public and commissioner questions focused on whether the cemetery had been fully investigated. The applicant’s representative, Charles Way, and the applicant's surveyor/agent said they conducted boundary surveys and identified marked graves and headstones within the fenced cemetery parcel but did not perform ground-penetrating radar across the wider site. "We didn't do ground-penetrating radar on this site," the applicant's agent said, and county staff noted that county regulations do not require subsurface testing unless remains are uncovered during construction and must be reported under state law.
Developer Charles Way said the site plan already had approval and that the change would allow units to be sold as fee-simple lots; he said the current amendment slightly reduced the unit count compared with what could be developed under the existing approvals. Planning staff offered to follow up with the recorded owners of the cemetery parcel (identified in county records as "Scarlett G S H and D, care of Nightingale, Lyles and Denner") to obtain additional information.
