Fairview Farm HOA urges Nicholasville to uphold 2005 memorandum requiring park space on Saha property

Nicholasville — During the public-comment period of the Oct. 28 commission meeting, Chesley McCall Jarris, speaking for the Fairview Farm Homeowners Association, told the commission a memorandum of agreement dated July 19, 2005 between the Saha family and the city requires that, if the 76-acre parcel at 3218 Lexington Road is developed, the development plan must include a park space not to exceed 2.5 acres.
"This memorandum of agreement dated 07/19/2005 contains a stipulation that if the Saha property at 3218 Lexington Road is ever developed, the development plan must include a park space not to exceed 2 and 1 half acres," Jarris said.
Mayor Carter and staff replied that the item has not yet come before the commission. Mayor Carter and staff said they would review the dated memorandum and bring it back for further consideration at an upcoming meeting.
The public comment flagged potential gaps in the 2005 document; staff said they and the commission will revisit the memorandum in coming meetings to clarify enforceability and how any required park space would be implemented as development proceeds.
No formal action was taken on the record at the Oct. 28 meeting; the commission directed staff to review the memorandum and report back.
