Council clears way for gym in industrial park, approves permitted-use classification

Parlier City Council voted to allow a gymnasium-type use to be a permitted use in parts of the city's M-1 (manufacturing) zoning district, reversing the staff's initial recommendation that the use was not similar to existing allowed uses in that zone.
Staff presented three options for handling the request: deny similarity, allow with modifications, or direct staff to amend the zoning text citywide. Council discussed impacts to nearby dwellings, hours of operation, and whether to make the use permitted or conditionally permitted. Council chose to make the use a permitted use so an operator could obtain a business license without a conditional-use permit.
Chris Silva, owner of BP Gym, told the council his operation had previously served about 30 members and operated daily "from 5AM to 10PM." He said the facility used cameras and had been popular with working residents. Staff and council debated whether existing residences adjacent to the industrial park were grandfathered and how new uses would be handled; staff said continuous historical uses could be grandfathered but a change of use requires conformance with current zoning.
Council voted in favor of the motion to classify the gym as a permitted use (motion by Diego, second Janie); the motion carried by voice vote. Staff said that if approved, the pending business license application submitted in October would be processed and a business license issued once requirements were met.
The action does not set operating hours in the zoning amendment; if council had made the use conditionally permitted, it could have attached conditions such as hours of operation. The council instead opted for the permitted-use route to streamline opening for an existing building.
