Danvers ZBA grants variance for addition at 116 Burley Street

The Town of Danvers Zoning Board of Appeals on Dec. 16 approved a variance for 116 Burley Street to allow an addition to be located 17.9 feet from the side property line, where the bylaw requires 20 feet.
Applicant Dan Slattery told the board that after checking with the assessor and reviewing the architect's drawings, the measured eave puts the addition at 17.9 feet from the side property line. "With the eave, it is 17.9," Slattery said, and he provided a revised plot plan reflecting that figure.
Board members asked whether a building permit had been pulled; Slattery said a permit had not yet been issued but that the permit would reflect the 17.9-foot measurement. A board member moved to issue the variance, saying the reduced dimension would not adversely impact adjacent properties and would not substantially deviate from the intent of the zoning bylaw. A colleague seconded the motion and the board voted in favor.
The approval was recorded as Docket 24-5090. The board did not attach further conditions in its motion beyond the finding that the reduced setback would not be detrimental to the public good. The applicant was told to proceed with permitting consistent with the approved dimension.
The board then moved on to the next docket item.
