The Orange County Planning Commission recommended approval of Special Use Permit 2024‑00238 for DOM LLC (to allow a new sign at an existing gas station) subject to conditions requiring dumpster screening, correction of nonconforming lighting and a stipulation that all conditions must be satisfied before a sign permit is issued.
Staff reported that the applicant or their agent did not appear in person or virtually for the hearing; planning staff and commissioners discussed enforcement options and the practical leverage of withholding a sign permit until SUP conditions are met. Commissioners expressed frustration at the applicant’s absence but also noted that approving the SUP with clear conditions would give the county a mechanism to require improvements.
Commissioner DePasquale moved to recommend approval with the amended conditions; the motion carried on roll call. The conditions included screening for dumpsters, bringing the site lighting into compliance with the zoning ordinance, and making compliance a precondition of issuing the requested sign permit. Staff told the commission it would list the recommended conditions in the staff report and that the sign permit could be withheld until compliance is demonstrated and verified through the county’s compliance process.
What’s next: the recommendation, staff report and the commission’s stated conditions will be transmitted to the Board of Supervisors for final action.
