Planner Kira Davis presented SUP00238 on behalf of Dom, LLC, for a 4.5-acre property at 4201 Spotswood Trail in Barbersville, proposing to bring an existing fuel-dispensing operation into compliance and to permit increased signage.
"Tabitha Galling, on behalf of Dom LLC, has applied for a special use permit to allow for fuel dispensing, which is an existing nonconforming use on the property and to install increased signage," Kira said. She told the board the planning commission recommended approval with conditions: prohibit digital signage other than fuel-price displays, require opaque screening of the dumpster, and bring exterior lighting into zoning compliance.
Board members discussed a documented crash history on US-33 near the site and VDOT’s subsequent recommendation that the entrance closest to the US-33/Albano Road intersection be closed to reduce conflict areas. The property owner/operator in the room said upgraded signage would improve visibility of posted prices at highway speed. Board members balanced safety recommendations from VDOT against practical concerns about traffic circulation and congestion within the small site.
After the public hearing (no public commenters signed up), the board moved and voted to adopt the special-use permit as presented with the planning commission conditions. Roll call recorded four 'aye' votes and one 'nay.'
What’s next: the applicant must meet the permit conditions before new permits for the property will be approved; any expansion of fueling would require an amendment to the SUP.
