Committee approves two Lane Estates partial plat vacations to allow future replatting

The DeKalb County Plat Committee on Nov. 5 approved two partial plat vacations requested by Chad and Brenda Hoff for Lane Estates Lot 5 (6770 County Road 32) and Lot 6 (6754 County Road 32) to allow future replatting of the parcels.
Chris, the Zoning Administrator, presented findings for both petitions, citing completed applications (filed Oct. 7, 2024), legal notices published Oct. 25 and agency responses from the County Board of Health, County Highway Department, Drainage Board, County Surveyor and the DeKalb County Soil and Water Conservation District. For Lot 5, Chris told the committee the vacation was necessary to allow the petitioner to combine parcels and later create a new minor subdivision; staff concluded the action is in the public interest and recommended approval.
Neighbors raised questions during public comment. Robert Ross, of 3364 State Road 1, said he lives on adjacent Lot 4 and asked how many houses a future subdivision would include. Chris and others responded that the term "minor subdivision" is a statutory terminology and that no detailed lot layout has been submitted; another public commenter, Nathan Perkins, said he purchased his home in 2024 expecting existing restrictions and asked for a detailed plan before restrictions are removed.
Applicant Chad Hoff addressed the committee and said he owns the two lots and expects to redivide them into two lots (approximately a 3‑acre lot and a 5‑acre lot) with access from County Road 32. "It's basically just gonna be 2 lots, the same as the existing is now," Hoff said, urging that the notice wording caused confusion.
For the Lot 6 petition, staff again reviewed required notices and agency comments and recommended approval, noting that covenants from the original plat will be incorporated on any future replat and that septic and utility matters will be addressed when an actual subdivision application is filed. Committee member discussion confirmed those clarifications.
Suzanne Davis moved to approve the Lot 5 vacation; Sandy Harrison seconded. For Lot 6, Jerry Yoder moved and Sandy Harrison seconded. Roll‑call votes on both actions recorded "Yes" from Sandy Harrison, Suzanne Davis, Jason Carnahan, Jerry Yoder and Alicia Rogers; both motions passed.
The committee recorded that appropriate agricultural, drainage and airport‑zone covenants, if required, will be placed on any future plat and that the Zoning Administrator will determine when pre‑recordation conditions have been satisfied. Any future minor subdivision will require a separate public hearing with lot layouts and septic/driveway details.
