The Planning Commission approved a request to vacate a 7-foot road easement along Nicholas Road that is part of the Joiner Ranch East development project. Commissioner Jerry Johnson raised concerns that reducing the right-of-way could constrain landscaping and reduce sound-absorption between a sound wall and the roadway; staff responded that the approved tentative map and improvement plans show a separated sidewalk and a landscaping corridor of roughly six to seven feet between the road and the back-of-lot wall, and that vacating the easement removes only the encumbrance but not the physical landscaping or sidewalk.
SP, the senior engineer in Development Services, said the underlying title to the strip is held by the applicant and that the vacation is consistent with the tentative map approved by the Commission and City Council in 2021. SP described the cross section: road, separated sidewalk, landscaping on both sides of the sidewalk and then a sound wall where lots begin. Commissioners were satisfied the landscaping corridor would remain and that the change is consistent with prior approvals; Commissioner Jerry Johnson moved approval and the Commission carried the motion unanimously on roll call.
The record shows the Commission’s action was a consistency finding and vacation of the encumbrance; no change to existing sidewalks or landscaping was proposed at the hearing.
