Rising Sun outlines subdivision code updates to meet MS4 stormwater obligations

Town Administrator told the board on Aug. 22 that ordinance 2024‑05 clarifies definitions and aligns the town's subdivision and land development code with state and federal stormwater obligations (MS4/Clean Water Act requirements). He said developments disturbing more than 5,000 square feet would trigger a site assessment (desktop and field) subject to town engineer approval.
Administrator warned of an estimated $1,700,000 unfunded MS4 compliance expenditure the town must address by December 2025 and said the draft requires developers to assist with stormwater and restoration measures. He described credits for tree planting that help MS4 compliance and said homeowners associations (for residential subdivisions) or property owners (for commercial sites) would be responsible for maintaining plantings and stormwater features.
The board heard no citizen comments on this item; the ordinance will be posted and considered at a future meeting. Commissioner Emily Kleiner reported the planning commission reviewed the ordinance and provided comments available for review.
